Tax Notice After a Refund Claim: Your Next Steps

A notice after claiming or receiving a refund needs careful reading, but it does not by itself establish that the claim was fraudulent. The Department may seek confirmation, propose an adjustment, identify a defect or raise a demand after further review. Your first task is to identify that exact issue and the response deadline, then compare it with the filed return.
Choose the correct income period
For income earned from 1 April 2025 to 31 March 2026, select Assessment Year (AY) 2026-27 and apply the Income-tax Act, 1961. Income earned from 1 April 2026 belongs to Tax Year 2026-27 under the Income-tax Act, 2025. These are different periods. A return or notice about an earlier year does not move to the new Act merely because you handle it after April 2026.
Authenticate the message and obtain the full document
Open the Income Tax e-filing portal independently and inspect the relevant communication and notice-authentication service. Check PAN, assessment year, reference, issue date and attachments. Save the complete document rather than relying on an SMS summary. Treat any request for an OTP, bank PIN or payment to an unfamiliar account as separate from the official response process and verify its authenticity before acting.
Classify what the Department is asking
A refund-confirmation request differs from a defective-return notice under section 139(9), a proposed adjustment during processing, a section 143(1) intimation or a scrutiny notice. A demand or order after a refund was issued can involve another remedy. Identify the operative direction, amount and deadline. Do not assume that a refund dashboard status replaces the instructions in a separate communication.
Rebuild the refund calculation from evidence
Compare the return’s income, deductions, tax, interest, fees and tax credits with the Department’s figures. Check Form 26AS, employer or client certificates and genuine challans. Review whether an exemption or deduction was available under the chosen regime and whether the supporting payment actually occurred. A credit mismatch, unsupported deduction and omitted income require different explanations, even if all reduce the claimed refund.
Prepare a focused response and any necessary correction
Create a table showing each queried item, your calculation, the difference and the supporting annexure. Answer the actual questions and attach readable records. If you identify an error, assess whether a revision, defect response, rectification or other procedure is legally available and appropriate. A reply denying every difference is not useful when the records show a genuine mistake. Conversely, do not concede an unsupported amount without checking it.
Track the result and distinguish later remedies
Submit through the prescribed portal route and retain its acknowledgement. If more time is needed, request it properly and check whether it is granted. A grievance does not substitute for a statutory reply or appeal. Read the resulting intimation or order and calendar any next deadline. No adviser can promise that a refund will be released within a fixed number of days or that a demand will be withdrawn.

- Reconcile the refund calculation against the return and source records.
- Index each explanation and supporting document before uploading the reply.
- Keep the response acknowledgement and review the next order or message.
Worked example
Illustration: a taxpayer claimed a refund because a client deducted tax, but the processing record does not show the same credit. The taxpayer checks Form 26AS, the certificate and the reported income, then asks the client to investigate its statement. The taxpayer also responds to the actual notice with the available evidence before its deadline. Client correction and notice compliance are coordinated, but waiting for one does not automatically extend the other.
Frequently asked questions
Does a notice mean the refund must immediately be repaid?
Not necessarily. Identify whether the document proposes an adjustment, requests information or contains an enforceable demand, then assess the proper response.
Should I file another return immediately?
First diagnose the issue. A notice reply, revision and rectification have different purposes and conditions.
Can I send only a bank statement?
Provide the evidence relevant to the queried issue and explain which entries support your position. An unindexed statement may not answer the question.
What if the refund was already credited?
A later lawful review or demand can still require attention. Preserve the refund and tax records and assess the specific document.
Can an updated return increase my refund?
No. ITR-U cannot create or increase a refund. Review the legally available remedy for the actual issue.
