Trademark Examination Replies: Evidence and Deadlines

Prepare a response to the actual examination report, understand the receipt-based response period and organise genuine supporting evidence without promising acceptance.

A trademark examination reply must address the objections in the actual report. Begin with the application number, applicant, mark, class and goods or services, then retain the communication and the date it was received.

Check the response period carefully

Rule 33 uses a period of one month from receipt of the examination report. If no response is received within that period, the Registrar may treat the application as abandoned. A calendar month is not always the same as 30 days. Confirm the case record and any relevant direction before setting the date. [S14]

Build an objection-by-objection record

  • Copy each objection accurately into a working checklist.
  • Identify the application facts relevant to that objection.
  • List genuine supporting records and any missing evidence.
  • Have the proposed explanation assessed for the actual case.
  • Record who authorises the final response.

Evidence of use, ownership or distinctiveness should relate to the actual mark and goods or services. Do not invent invoices, dates of use or retrospective records to strengthen a reply.

What happens after submission?

Keep the authorised response and acknowledgement. Further examination or a hearing may follow. Filing a reply does not guarantee acceptance or registration.

Can one standard reply answer every objection?

No. A response needs the applicant's facts and the actual grounds raised. A checklist helps organise the work; it cannot decide the merits of a particular application.
